Supreme Court restrains Gyakye Quason from holding himself as MP

 

The Supreme Court has ruled that Member of Parliament for Assin North Constituency, James Gyakye Quayson cannot hold himself as a lawmaker in Ghana’s Parliament.

In a majority decision of 5-2 by justices of the Supreme Court, the court ruled that Mr. Gyakye Quason cannot hold himself as a representative for the people of Assin North until the final determination of the petition filed against him by Michael Ankomah-Nimfa.

The decision, which was taken on Wednesday, April 13, 2022, came because the legislator was deemed unqualified to contest the Assin North parliamentary seat because, he owed allegiance to another country [Canada] at the time he filed his nomination which contravenes the 1992 Constitution.

The 7-member panel saw Justices Agnes Dordzie and Nene Amegatcher dissenting while Prof. Henrietta Mensah Bonsu, Mariama Owusu, Gertrude Torkornoo, and Emmanuel Yonny Kulendi were in favour.
